In conjunction with providing services to a policyholder, claimant, or provider, including processing bills from providers and processing claims for claimants, NYSIF may collect information from third parties, some of which you may have already voluntarily provided to NYSIF, as described below.

Neither NYSIF.com nor NYSIF’s mobile applications target children who are under the age of 13. NYSIF does not knowingly collect Personal Information from children or create profiles of children who are under the age of 13 through either NYSIF.com or NYSIF’s mobile applications. Users are cautioned, however, that the collection of Personal Information provided by any individual in an email or through an Online Transaction will be treated the same as information given by an adult, and may, if not exempted from access by federal or state law, be subject to public access under the Freedom of Information Law or other provisions as more fully set forth below. NYSIF strongly encourages parents and teachers to be involved in children’s Internet activities and provide guidance whenever children are asked to provide Personal Information.
NYSIF uses the information that NYSIF collects for the purposes described below or as otherwise described at the point of collection:
NYSIF is strongly committed to protecting Personal Information Collected by NYSIF against unauthorized access, use, or disclosure. NYSIF limits access to Personal Information Collected by NYSIF to only those employees and authorized business partners, such as contractors and subcontractors, who need access to perform a specific job in connection with their duties. In addition, NYSIF has implemented procedures to safeguard its information technology assets including, but not limited to, authentication, monitoring, auditing, and encryption. These security procedures have been integrated into the design, implementation, and day-to-day operation of NYSIF’s Online Resources as part of our continuing commitment to the security of electronic content as well as the electronic transmission of information.
For security purposes and to maintain the availability of the Online Transaction processes available through NYSIF.com. NYSIF employs software to monitor traffic and to identify unauthorized attempts to upload, download, change, access, or otherwise damage NYSIF.com.
The collection and disclosure of Information Collected by NYSIF through NYSIF.com are subject to the provisions of the Internet Security and Privacy Act. Additionally, the collection and disclosure of Information Collected by NYSIF through other means, such as NYSIF’s Mobile Apps and email sent to NYSIF, is subject to the Freedom of Information Law, Personal Privacy Protection Law, and the Workers’ Compensation Law. Except as provided below, or as otherwise provided by law, NYSIF will only collect or disclose Personal Information Collected by NYSIF if the user has consented to the collection or disclosure of such Personal Information. NYSIF may disclose Personal Information collected through NYSIF.com to Federal or State law enforcement authorities to enforce NYSIF’s rights against unauthorized access or attempted unauthorized access to NYSIF’s information technology assets or against other inappropriate use of NYSIF.com.
The Information Collected by NYSIF is retained by NYSIF in accordance with the records retention and disposition requirements of the New York State Arts & Cultural Affairs Law. Information on the requirements of the Arts & Cultural Affairs Law may be found at the New York State Archives. Information, including Personal Information submitted to NYSIF online, regardless of whether the Personal Information is submitted through an Online Resource or through email, is retained in accordance with the schedule for records retention and disposition established for the relevant NYSIF unit. Information concerning these records’ retention and disposition schedules may be obtained through the contact listed at the end of this Privacy Policy.
Any user may submit a request to the NYSIF Privacy Compliance Officer to determine whether any Information Collected by NYSIF pertains to that user. Information about an individual is held in one or more records maintained by NYSIF. Any such request(s) must be made in writing to the NYSIF Privacy Compliance Officer at the address below, include the information listed below, and must be accompanied by reasonable proof of identity of the user. Reasonable proof of identity includes a notarized signature, copy of your driver’s license, passport, or other official picture identification, inclusion of an identifier generally known only to the user, or similar appropriate identification. If additional proof of identify is required, you will be notified.
Your request for disclosure of records about you maintained by NYSIF must also include enough information to enable NYSIF to conduct a search for your records. At a minimum, you must include your name and any identifier that may be associated with you, such as a claim number or account identifier. Without enough information about you, NYSIF may not be able to complete a records search.

The Privacy Compliance Officer shall, within five (5) business days of the date of the receipt of a proper request: (1) provide access to the requested information; (2) deny access in writing, explaining the reasons therefore; or (3) acknowledge the receipt of the request in writing, stating the approximate date when the request will be granted or denied, which date shall not be more than thirty (30) days from the date of the acknowledgment.
In the event that NYSIF finds the requested Information Collected by NYSIF and such information will be provided to the user pursuant to the user's request, the Privacy Compliance Officer shall inform the user of their right to request that the disclosed Information Collected by NYSIF be amended or corrected under the procedures set forth in section 95 of the Public Officers Law (the Personal Privacy Protection Law).
